Planning for the future isn’t just about making a Will. While a Will ensures your assets are distributed after your death, what happens if you become unable to make decisions during your lifetime – whether temporarily or permanently?
Many people don’t realise that no one, not even a spouse or child, has an automatic right to make decisions for you if you lose mental capacity. Without the right legal protections, the Court of Protection would need to appoint a Deputy, which can be a long, costly process with ongoing annual fees.

What is a Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document you can create while you have full mental capacity, allowing you to appoint trusted individuals to make important decisions on your behalf.
There are two types of LPA:
- Property & Financial Affairs – Covers managing your finances, property, and bills
- Health & Welfare – Covers decisions about medical treatment, care, and daily living
For an LPA to take effect, it must be registered with the Office of the Public Guardian.
