Having both a Will and a Lasting Power of Attorney (LPA) in place falls firmly into the latter category. Together, they provide clarity, protection and peace of mind for you and for those you care about most.
Why a Will matters
A Will ensures that your estate is passed on according to your wishes, and gives you control over:
- Who inherits your assets
- Who looks after your children
- How vulnerable loved ones are provided for
- Who is responsible for carrying out your instructions
Without a valid Will, your estate is distributed according to strict legal rules, which may not reflect your wishes or your family situation. Worse, it can create conflict, delay and unnecessary cost at an already difficult time.
Why a Lasting Power of Attorney is just as crucial
While a Will deals with what happens after you die, a Lasting Power of Attorney (LPA) protects you while you are still alive.
An LPA allows you to appoint trusted individuals to make decisions on your behalf if you lose the ability to do so. There are two types:
- Property and Financial Affairs LPA – covering bank accounts, bills, pensions, and property
- Health and Welfare LPA – covering medical care, daily routines, and end-of-life decisions
Without an LPA, your family may find themselves unable to act, even to pay your bills or make urgent healthcare decisions. In that case, they would need to apply to the Court of Protection, which can be slow, costly and distressing.
Preparation is the best protection
A Will and an LPA work together. One looks after your legacy, the other safeguards your wellbeing. Yet many people delay putting them in place until it is too late.
